The Court of Protection has recently published a useful case highlighting why and when a personal welfare (rather than financial) deputy would be appointed by the court. The case involved a 27 year old man with a moderate learning disability and hearing and visual impairments. There was a long running disagreement between his mother and local authority and ICB about where he should live and the most appropriate care package. The judge authorised the appointment of an independent personal welfare deputy with no links to any of those involved.
