The use of covert medication was identified by the CQC in a recent inspection report (13 March 2024). Hilltop Hall nursing home received an inadequate rating. One reasons for this was: ‘Covert medicines were not being managed in line with the principles of MCA. Appropriate MCA and best interest decisions were not always found within people's care records with consideration of which medicines met the criteria for being administered covertly.’ Download the inspection report from HERE.
The key case law on covert medication is the case of Re: A (Covert medication: residence) where the Court of Protection judge confirmed the authority of previous guidance on the procedure that should be followed. Download the case from HERE.
